ON CERTAIN MODELS FOR THE RESOLUTION OF THE STATUS OF KOSOVO AND METOHIJA

Abstract
The paper contains an analysis of certain hereto presented proposals for the resolution of the status of Kosovo and Metohija (KiM). Among these numerous proposals, a certain number of these are based on existing solutions in other countries, so that they are used as a model for the status of KiM. The analysis separates existing solutions into groups, i.e. a group of solutions which do not contain a sufficiently high degrees of modern autonomy applicable to a territorial-political unit, a group of solutions connected with widely spread confusions and misconceptions regarding their essence and group containing three solutions which, in the author’s opinion, have the capacity to be utilized in the form of experience and model – Northern Ireland, Hong Kong and Macao. Although these three solutions are not comparatively speaking a novelty, they are known to the general (especially layman’s) public, and their value is exceptionally high, not only due to a potentially positive influence on the resolution of the status of KiM, but also for constitutional law theory, since they diverged from it classical and conventional tenets, which are based on exclusion and a clear differentiation of categories.
