THE RIGHT TO PRIVACY IN EUROPEAN CONVENTION ON HUMAN RIGHTS

Abstract
This paper analyzes the right to privacy, as it is stipulated in Article 8 of European Convention on Human Rights. Starting point is history of development of human rights in general and overview of international instruments for protection of human rights on global, regional and national level. Special attention is devoted to Article 8 of ECHR, as it has set basic rules on interpretation of the right to privacy. Next, the focus shifts on related rights of ECHR, with the goal of pointing out similarities with the right to privacy. Also, research deals with definitions of the right to privacy in other international documents and within legal system of Serbia, in order to build solid comparative fundament.
Main goal of this research is to determine the level of protection of a person according to international legal instruments when violation of the right to privacy happens. In that sense, most indicative are decisions of the European Court of Human Rights.
