CRIMINAL PROCEDURE IN JAPAN

In this paper the author presents the basic characteristics of the criminal procedure in Japan. It contains three parts. The first part presents historical development of the criminal procedure and the impact of different legal traditions (Chinese, European and Anglo-American) on positive sources of law in Japan. In the second part, using the dogmatic approach, the author analyzes the main subjects of the criminal procedure (the court, the prosecutor, the defendant and the counsel). The third part gives a summary of the course of criminal procedure in Japan.
